Legal Speak

By using the Raytown Productions online mixing, mastering, and/or production service(s), you (Customer) agree and are bound by the following terms of service:

TURN-AROUND TIME

You should expect to receive the first sound check file of the supplied work within two to ten business days from order completion or from download of audio stems. Turnaround time is based on current work load, the order received, and the tasks involved in your project. We do not guarantee these turn around times.

Delays may occur if uploaded files do not conform to standards listed in the frequently asked questions section of the website (https://www.raytownproductions.com/faq). If your order has any problems or concerns, we will contact you.

REVISION POLICY:

Raytown Productions wants you to ensure you receive a product you are completely satisfied with. For all of our services, we offer unlimited adjustments/revisions free of charge for ten days after the delivery of your first sound check file as a courtesy and reserve the right to terminate revisions at any time.

REFUND POLICY:

The mixing, mastering, and/or production services are considered non-refundable once the engineer has begun working. Unlimited revisions/adjustments for ten days are provided as a courtesy for all mixes, masters and production work to resolve any issues Customer has with the services.

If you fail to respond to any production or mix/master sound check files within 10 days of the Customer receiving the files, the services will be automatically finalized and you’ll receive the final files. No further adjustments or corrections will be made at a rate of $60/h.

Unless specifically requested by Raytown Productions, no files will be added or replaced to any service once work has begun. To update or add files to any submitted project requires an additional payment of the service being performed (mixing, mastering, or production work) at a 50% discounted rate. Please make sure the submitted audio files are the exact files you want Raytown Productions to work on.

YOUR WARRANTY TO US:

Customer is the rightful owner of the Master Recording and/or Composition and all elements contained therein and warrants that it does not violate any law or infringe upon or violate the rights, including without limitation all copyright rights, of any individual or entity. If Customer is not the rightful owner then they warrant to Raytown Productions that they have the necessary and required permission/license from the rightful owner to re-record, edit and/or modify the Master Recording and/or Composition. Customer agrees to indemnify Raytown Productions its agents or assignees and hold them free and harmless from and against any and all claims, liabilities, costs, losses, damages or expenses, including but not limited to, reasonable attorney fees and court costs, arising out of any failure or breach by Customer with respect to its warranties as set forth in this Agreement. Customer agrees to give due credit to Raytown Productions and its engineer Bobby Balow for the services requested by Customer. This credit must also be provided to distributors, managers, and/or mastering engineer(s) and included on any digital and/or physical product.

RESPONSIBILITY:

Raytown Productions is not responsible for loss or damages caused by using its services.

Customer waives the right to bring any legal action(s) against Raytown Productions and/or its staff due to any damages or loss, financial or otherwise, resulting from customers use of our recording, tracking, mixing, editing, mastering, production and/or consulting services.

Raytown Productions reserves the right to refuse service at its discretion and/or terminate service at any time.

Raytown Productions only maintains your tracks for a limited period of time following the completion of each project. It is your responsibility to download and store the completed mix and master files within that time period.

The privacy of our customers and their songs is very important to us.

Raytown Productions may use the work in whole or in part only for promotional uses only pertaining to its service (such as placing clips on social media, the webpage, or other internet audio/video streaming sites such as Soundcloud, YouTube, Facebook, etc.). We respect all of our customer’s privacy, so we typically ask before releasing promotional content.

These Terms of Service may be amended at any time without notice.
